Ireland Fines Coinbase €3.25M for Safeguarding Failures: Regulator Details Underfunded Accounts

The Central Bank of Ireland has imposed a €3.25 million settlement penalty against Coinbase Ireland Limited for historical failures in protecting customer funds and overseeing outsourced processes. The regulator’s findings are more specific than a general compliance dispute: it says designated safeguarding accounts were underfunded for extended periods.

In its October 22 enforcement notice, the central bank said Coinbase Ireland breached safeguarding and outsourcing obligations under Ireland’s 2011 Electronic Money Regulations between November 1, 2020 and August 19, 2025. The company admitted the prescribed contraventions and accepted the settlement, which remains subject to confirmation by the High Court.

The regulator initially determined that a reprimand and a €4,646,597 monetary penalty were warranted. The amount payable was reduced to €3,252,618 after a 30% settlement discount. It is important to distinguish the accepted settlement from a court-confirmed sanction until the specified confirmation step is complete.

Three weaknesses in handling customer money

The central bank identified insufficient oversight of outsourced safeguarding functions, inadequate design and testing of systems used to calculate customer money requirements, and failures to communicate material safeguarding changes effectively. It criticized excessive reliance on the US-based Coinbase group without enough local expertise to supervise the Irish entity’s obligations.

These concerns involve Coinbase Ireland’s electronic-money business, which supports fiat services for customers trading on the broader Coinbase platform. They are not necessarily findings that a specific blockchain wallet was breached or cryptocurrency was stolen. That legal distinction matters when assessing what customer protections were at issue.

Coinbase’s own response says no customer suffered a financial loss or lost access to funds because of the historical deficiencies, and that the firm has corrected the processes. The regulator’s finding of underfunded safeguarding accounts and the company’s claim of no realized losses can both be true; actual loss is not required for a serious safeguarding control failure.

The firm says it introduced strengthened controls, third-party validation and an additional €25 million guaranty bond. Those actions should be assessed separately from the breaches identified for the earlier period.

A warning about custody and corporate structure

The Irish decision illustrates why a familiar global brand does not erase the legal boundaries between its subsidiaries. A customer may use one interface but receive different services from distinct regulated entities, subject to different rules and protections.

Safeguarding generally requires an e-money institution to protect funds owed to customers rather than treat them as ordinary company working capital. Calculating the amount correctly and holding it in properly designated accounts are basic operational disciplines, especially when balances change frequently.

Investors should examine the entity named in their terms, what assets are safeguarded and how the firm responds if a reconciliation error occurs. The central bank’s case is a reminder that organizational and data-control failures can be financially material even without a cyberattack.

For Coinbase, the outcome creates a documented enforcement record in Europe while the company expands into more financial products. Future performance should be judged by the sustained effectiveness of its controls, rather than either treating the fine as proof of inevitable customer losses or dismissing it solely because none were reported.
